Summary of Law Effective through September 30, 2008

Effective as of October 1, 2008

Ages/Positions Covered:
» This law covers children less than age 16 riding in open beds of pickup trucks or other open cargo area.

Vehicles Covered:
» Vehicles having open beds or cargo areas without permanent overhead restraining construction.

Restraint Required:
» Transport in open bed or open cargo area prohibited.

Exemptions:
» If adult is present in bed or cargo area and is supervising the child.
» If child is secured or restrained by seat belt in compliance with FMVSS 208 installed to support load of 5,000 lbs. for each belt and of a type approved by the Commissioner.
» An emergency situation exists
» Vehicle is being operated in a parade.
» The vehicle is being operated in an agricultural enterprise, including providing transportation to and from the principal place of the agricultural enterprise.

Responsibility/Penalties:
» Driver responsible for all children less than age 16.
» Penalty of not more than $25.00, even if more than one child less than 16 years of age is riding in the open bed or open cargo area of a vehicle..
» No court costs apply.
» No driver license points
» No insurance points.


Effective through September 30, 2008

Ages/Positions Covered:
» This law covers children less than age 12 riding in open beds of pickup trucks or other open cargo area.

Vehicles Covered:
» Vehicles having open beds or cargo areas without permanent overhead restraining construction.

Restraint Required:
» Transport in open bed or open cargo area prohibited.

Exemptions:
» If adult is present in bed or cargo area and is supervising the child.
» If child is secured or restrained by seat belt in compliance with FMVSS 208 installed to support load of 5,000 lbs. for each belt and of a type approved by the Commissioner.
» An emergency situation exists
» Vehicle is being operated in a parade pursuant to a valid permit.
» Vehicle is being operated for agricultural purposes.
» In counties with no incorporated town with a population greater than 3,500.

Responsibility/Penalties:
» Driver responsible for all children less than twelve.
» Penalty of $25.
» No court costs apply.
» No driver license points
» No insurance points.
